In 1986 California enacted Proposition 65 (“Prop 65”) into California state law, also known as the Safe Drinking Water and Toxic Enforcement Act. This Act requires a warning on all products sold in California containing one or more of the 900 chemicals known to the State of California to cause cancer, birth defects or reproductive harm. The list is maintained by the California Office of Environmental Health Hazard Assessment (OEHHA), and can be found online at www.oehha.ca.gov/proposition-65/proposition-65-list. A Proposition 65 warning does not mean that a product is in violation of any product safety standards or requirements. Prop 65 warnings are intended to allow consumers to make informed choices and take precautions about the products they purchase and are exposed to that contain potentially hazardous chemicals.
WARNING: Under Prop 65, businesses (including manufacturers, distributors and retail sellers) making sales to customers in California are required to give a “clear and reasonable warning” for products containing chemicals on the Prop 65 chemical list. Amended Prop 65 regulations took effect on August 30, 2018, and we have taken steps to ensure compliance with these new Prop 65 warning requirements. As one of our distributors, it is also important that you comply with these new Prop 65 regulations.
